Business Strategy with Kell Quarrell Agreement

Definitions

The following definitions apply to this Agreement:

Agreement means the agreement between the Client and Kell Quarrell for Business Strategy & Coaching Services under and in accordance with these Terms and Conditions.

Agreement Date means the date you execute this Agreement.

Client, you, your means the party purchasing the Strategy Package as identified on the Purchase Order

Details means the Agreement Details to which these Terms and Conditions are attached.

Fee means the fees for the Business Strategy Package, as stipulated in the Purchase Order.

Terms and Conditions means these terms and conditions. Services means the services provided by Kell Quarrell to the Customer.

Kell Quarrell, me, I means Trading Name: Kell Quarrell for AA & KJ Quarrell Family Trust ABN: 95 192 405 065

By accepting these Terms and Conditions, the client agrees to pay the Business Strategy fees (including GST) for services with Kell Quarrell using the payment method selected on the Purchase Order.

The client accepts that she is required to pay the full amount of the Package fees even if she does not complete all sessions.

The duration of 1:1 Strategy Services with Kell Quarrell is stated on the checkout page.

The package commencement is the date in which the package is purchased unless otherwise mutually agreed upon in writing.

Client Engagement

Client engagement is complete when the client has been issued a username and password for the Members Portal.

Strategy services duration is effective from the date in which the package was purchased.

Access to your secure online Members Site has no expiry.

Special offer coupon codes cannot be added to an enrolment retrospectively and must be added at the time of purchase.

Strategy Service fees are non-transferable to any one else.

Business Strategy Materials and Access 

Strategy Materials are supplied in an online environment (via the Members Portal), unless otherwise stated and are available for viewing online. They may be downloaded or printed only for you, the client, only.

All resources of Kell Quarrell including copyright and all other such intellectual property rights contained therein, remain the property of Kell Quarrell. You may not reproduce any part of the resources without the prior written consent of Kell Quarrell.

Resources comprise of written materials, web presentations, videos (where specified) and other learning resources. The Members Portal may occasionally be unavailable during scheduled maintenance. In the event that your site becomes unavailable, materials will be provided by another mode of delivery.

Withdrawal and Refunds

Kell Quarrell complies with Australian Consumer Law regarding refunds. We do not offer refunds for change of mind or if you decide not to proceed with your session or package after purchase.

In exceptional cases of extenuating circumstances, a 50% refund may be considered if a cancellation request is made within 7 days of purchase. This will be assessed on a case-by-case basis at the sole discretion of the Director. No refunds will be provided after 7 days.

Rescheduling Policy

To maintain the integrity of our scheduling and respect all clients' time, the following rescheduling policy applies:

• A minimum of 24 hours' notice is required to reschedule your session. If you provide at least 24 hours' notice, you may rebook your session at a mutually available time.
• If less than 24 hours' notice is given, or if you do not attend your scheduled session, your session will be forfeited and considered complete. No reschedules or refunds will be available in this instance.

By purchasing a session or package, you acknowledge and agree to these terms.

Confidentiality and Privacy Policy

We will make reasonable efforts to keep any such information that we have about you secure and to ensure that any of our employees or agents who have access to information about you do not make any unauthorised use, modification, reproduction or disclosure of that information.
We will only disclose information that we have about you:

to the extent specifically required by law; or

for the purposes of this agreement (including disclosing information in connection with any query or claim)

information provided by you is considered confidential and will not be divulged to any third party, nor will it be sold.

Upon purchase of Business Strategy Services, you will be subscribed to our mailing list and will receive our weekly newsletter.

Kell Quarrell Code of Practice

Kell Quarrell agrees to provide:

• A tax invoice upon completion of the purchase order.
• Login details to access the online Members Portal.
• A pre-session evaluation form 48 hours prior to your session.
• Strategy session resources, notes and session recordings within 24 hours of the completion of your session.
• A direct online message thread delivered through a platform agreed upon by both parties.
